Terms and Conditions 

1. Trafalgar Tours NZ Limited (‘Trafalgar’), (referred to as ‘Promoters’) are pleased to offer you this promotion (‘Promotion’) for certain Trafalgar trips that are booked and fully paid for prior to 15 December 2016 subject to these terms and conditions. 2. This Promotion is available from 8 September 2016 until 15 December 2016 unless otherwise varied or cancelled by the Promoters. 3. All dollar amounts referred to in these terms and conditions are in New Zealand dollars, and the Promotion is only available to New Zealand residents that book their flights and tours in New Zealand. 4. The tours that are eligible for this Promotion (‘Eligible Tours’) are featured in the Trafalgar Europe Summer 2017 brochure and on the Trafalgar website, for departures from 1 April 2017 to 30 September 2017 (subject to availability). 5. By claiming either of the deals available under this Promotion, you accept these terms and conditions. Nothing in these terms and conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights you may have under any applicable law including the Consumer Guarantees Act 1993. 6. If you book and pay for an Eligible Tour before 15 December 2016, you can choose between the following deals to save money on your Eligible Tour: Deal A: An Early Payment Discount of 10% off the price published in the relevant brochure, for booking and paying in full before 15 December 2016; OR Deal B: A flight credit (‘Flight Credit’) if you book your return airfares for your Eligible Tour (for the entire trip on the same airline) with Singapore Airlines or Emirates Airline before 15 December 2016. The amount of Flight Credit depends on how much your Eligible Tour costs. Flight Credit may not be available on all tours or all departure dates of a particular tour and the Promoters do not guarantee that all Europe Summer 2017 tours and departure dates will qualify for Deal B. Deal B is subject to the following terms and conditions: a. You can calculate your estimated Flight Credit by using the table above. If your Eligible Tour falls within a certain cost bracket, you will be eligible for the Flight Credit associated with that cost bracket. For example, if your Eligible Tour costs between $3,000 and $5,000, you may be eligible for an $800 Flight Credit (example only). If the number of guests travelling on the Eligible Tour, or the cost of the Eligible Tour, changes, your Flight Credit is likely to change. All prices are, unless otherwise stated, inclusive of GST. b. You must contact your travel agent or Trafalgar directly on 0800 484 333 so that they can verify the amount of your Flight Credit based on the specific Eligible Tour and departure date that you intend to book. If you change your tour or departure date, or you are unable to book the trip or departure date for whatever reason, you must call 0800 484 333 to check the new cost of your Eligible Tour and your new Flight Credit, as this is likely to change. c. The estimated Flight Credit associated with an Eligible Tour is based on the price of a twin/multi-share Eligible Tour. If you opt to add the single room supplement option to your Eligible Tour, you will not be entitled to any additional Flight Credit (even if this means that you are paying a higher amount for your Eligible Tour and fall into a different cost bracket). d. You must book and pay the full amount of the airfare that you will use for your Eligible Tour to your travel agent or to the airline directly, by 15 December 2016 or by the due date for payment, whichever is earlier. After you have booked and paid for your airfare, you must contact your travel agent or Trafalgar directly on 0800 484 333 so that they can verify your Flight Credit and your flight details, and apply your Flight Credit to your Eligible Tour booking. Provided that you have complied with these terms and conditions, your travel agent and/or the relevant tour company will arrange to deduct the Flight Credit from the outstanding amount due to be paid by you for the Eligible Tour. e. You may only use Deal B for one Eligible Tour booked by you before 15 December 2016. If you book more than one Eligible Tour before 15 December 2016, the second Eligible Tour (and any subsequent tours) that you book will only qualify for Deal A (Early Payment Discount). f. Flights must be booked with Singapore Airlines or Emirates. If flights are subsequently changed to a non-participating airline, your Flight Credit will be reversed and withdrawn and a new invoice will be issued for the full price of the Eligible Tour. You must pay this new invoice within [14] days of issue or before the departure date of the Eligible Tour (whichever is earlier). If you do not pay the invoice by the due date the relevant tour company has the right to cancel all or part of your tour activities. 7. Deal A and Deal B cannot both be used for the same Eligible Tour. Deal A or Deal B can be combined with past guest, second tour, and family & group discounts (as determined by the Promoters), but cannot be combined with any other offers, savings or deals offered by Trafalgar on any Eligible Tour. 8. This Promotion may be withdrawn or cancelled at any time without notice, and the participating airline partners may be changed from Singapore Airlines and Emirates to other airlines without notice. 9. Standard booking terms and conditions of Trafalgar apply to this Promotion and the booking of Eligible Tours, and the terms and conditions of Singapore Airlines and Emirates Airline apply to this Promotion. You must comply with all applicable terms and conditions. 10. Trafalgar and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, theft, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 11. Flight Credit is not transferable or exchangeable for cash, and may only be applied in reduction or reimbursement of the price of the Eligible Tour. 12. Trafalgar accept no responsibility for any tax implications that may arise from the use of the deals in this Promotion. 13. Your personal information (‘PI’) will be collected and held by the Promoters (or their related bodies corporate) to enable them to provide this Promotion. Your PI may be provided to third parties assisting in the conduct of the Promotion, including suppliers and travel agencies. If the PI requested is not provided, you may not claim under the Promotion. By participating in this Promotion you consent to the use of your PI as described.
