Terms and Conditions for River Cruises

2026 Terms & Conditions

We at Trafalgar want to do everything we can to make sure your cruise is enjoyable and worry-free. This page provides information about your cruise and contains terms and conditions (“Terms and Conditions”) which form the basis of the contract between you and Trafalgar Tours Ltd. In our brochure, on our website, and in these Terms and Conditions: “cruise” means the river cruise by the ‘Operators’ – Trafalgar Tours Ltd or and if a pre-cruise or post-cruise tour is provided in conjunction with that river cruise by that provider or by Trafalgar Tours Ltd, “cruise” includes such tour. “Vessel” means the conveyance for providing the cruise and, where relevant, the tour, and includes ships and motor coaches used for those purposes. Travel Corporation NZ Limited is the ‘Sales Company’ and the ‘Operators’ mentioned above, are collectively referred to as ‘Trafalgar’. The expressions “we”, “us” and “our” mean Trafalgar and persons taking advantage of the services offered by Trafalgar and other persons (if any) included with that person in the booking and that person(s)’ travel advisor (if any) are included in the expression “you”, “your”, “guest” or “passenger”. Travel advisors should request passengers read the Terms and Conditions prior to making a booking or any payment required by it.

 

By making a booking, the person doing so warrants that they have the authority of all other persons included in the booking to make it and accept and bind them to the Terms and Conditions. By confirming a booking by making any payment required by it, you acknowledge that a contract is made between you and us and that you are aware of, understand, accept, are bound by and will comply with the Terms and Conditions. The Terms and Conditions may be updated on our website or in writing by an officer of Trafalgar from time to time, but you will be bound by the version current as at the time of that payment. Transport aboard the vessel and other services forming part of the cruise are provided to you solely by vessel operators and other service providers pursuant to the terms and conditions of one or more Passenger Ticket Contracts (“PT Contract”) they will provide to you. A PT Contract contains clauses limiting the liability of the operator including limitations in respect of injury to or death of a passenger and damage claims relating to baggage and personal property. A PTContract is subject to the limitations of liability and time limits for making a claim under the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea, 1974 and the International Convention on Limitation of Liability for Maritime Claims, 1976. A PT Contract also includes a clause specifying that it is governed by the law of Switzerland, and that the courts of Rheinfelden, Switzerland, are the exclusive forum for resolving disputes. A copy of the Passenger Ticket Contract will be provided with your final documentation or earlier, upon request.

 

By confirming your booking by any payment required by it, you acknowledge that you are aware of, understand, accept and are bound by each relevant PT Contract and will comply with its terms. Trafalgar may, in its sole discretion, decline the booking of any passenger or cancel any booking of a passenger who does not or refuses to comply with the Terms and Conditions. In the event a passenger is removed from a cruise by the Operator, Trafalgar is not responsible for any costs incurred and passengers agree they will not hold Trafalgar liable for any such actions. Travel Corporation NZ Limited is responsible for only the services of reservation and ticketing. We do not accept any responsibility or liability in respect of the supply of any other services during or related to the cruise, or for any of the acts, omissions or defaults, whether negligent or otherwise, of any third parties, including, but not limited to, vessel operators and service providers.
